WHO SHOULD ATTEND: Attorneys whose practice includes real estate law, residential and commercial transactions and lending, and general civil practice.

OVERVIEW: Learn about the multiple mortgage fraud schemes arising nationally and specific schemes that have surfaced in Tennessee.  Mary Allisandratos discusses the origin of these schemes and what can be done to identify and avoid mortgage fraud in the future.  She will also describe how to recognize other “title hazards” in title searches, such as Foreclosure sales, Deeds in Lieu of Foreclosure and Short Sales, as well as what attorneys need to know to transfer clear and marketable title with such transactions affecting the subject property.

With the passage of Frank-Dodd and the creation of the Consumer Financial Protection Bureau, lenders are being held to a high standard of liability for their third party venders, such as title agents. These third party venders are also being asked to adhere to these higher standards.  The ALTA Best Practices were created to meet these demands. Andy Maloney describes how to create, implement and live up to these standards.
