WHO SHOULD ATTEND: Basic Estate Planning Documents is a seminar for general practitioners and anyone who does not regularly practice estate planning, but gets asked about it anyway. Attorneys whose practice areas include corporate and business, family, probate, litigation (general civil and commercial and business), real property and general practice will benefit from the program.
OVERVIEW: Attend this seminar and learn about, and prepare, basic documents for clients, family and persistent friends.
YOU WILL LEARN ABOUT 5 BASIC DOCUMENTS THAT MOST PEOPLE NEED:
A Durable Power of Attorney and A Durable Power of Attorney for Health Care
Discussion of Powers of Attorney will cover basic drafting issues of what powers to incorporate
as well as language to make sure the document is, in fact, durable. Additional topics of
discussion will include the dangers of powers of attorney. Then, we will cover ways to protect
your clients from the dangers and use of springing powers of attorney vs. other methods of
ensuring the fiscal and physical safety of your clients. Finally, discussion on powers of attorney
will cover where copies should be kept and the importance of not hiding them away in a safety
deposit box.
Living Will, Basic Will, and Trust
Discussion on Living Wills will touch upon how to reassure your clients that having a living
will does not mean the doctors will withhold essential care. The importance of having a living
will in every situation where there is a healthcare power of attorney will be discussed as well.
In the section on Wills and Trusts discussion will include the basic differences between wills,
revocable living trusts and irrevocable trusts. We will discuss how to help your client choose
between the options available to them and what to look for in helping them make that choice.
The dangers of an unfunded trust will be covered as well.
